These are the rental regulations for Wings of the Cascades, Spirit Flight, Inc. hereinafter referred to as “Wings” and instructors employed by Wings as employees or as contract instructors hereinafter referred to as “instructors”, and for all persons renting aircraft for any purpose, hereinafter referred to as “pilot.”
General
The pilot shall at all times remain the pilot-in-command, occupy the left front seat of the aircraft and at no time relinquish control of the aircraft to any other person. The pilot will assume full responsibility for the aircraft, and return it to Wings in the same condition as received. The pilot shall not operate the aircraft for commercial operations, flight instruction, acrobatics, or parachute drops. The pilot will be responsible for any necessary interior cleaning charges, at Wings' actual cost.
Waiver of one provision of this agreement does not constitute waiver of any other provision hereof, and no such waiver may be construed to require a continuing waiver of that or any other provision. In the event a dispute arises over this agreement, Oregon law shall control and if litigation is filed for breach hereof, the prevailing party shall be entitled to reasonable attorney fees at trial and on appeal.
All rentals are subject to aircraft availability. A checkout flight with a Wings Instructor is necessary for each type of aircraft the pilot wishes to rent. Wings always reserves the right to refuse rental of an aircraft to a pilot. All necessary check rides will be at the pilot’s expense. No reason for denial of a rental need be given and such a decision is solely the prerogative of Wings.
Charges
The pilot agrees to pay all rental charges incurred. All charges are due upon rental of the aircraft. Minimum daily charges may apply.
Certificates
The pilot must hold a valid and current pilot and medical certificate with the appropriate rating(s) for the intended flight. The pilot must have a written authorization for each type of aircraft rented. The pilot must have on file with Wings a current rental agreement, signed and fully agreed to by the pilot. The pilot expressly agrees to all provisions of this rental agreement.
Currency
Prior to any flight, the pilot must show written proof of a current annual or flight review, formerly (BFR), whichever is appropriate for the pilot. If three (3) months have passed since the pilot’s last flight in a specific type of aircraft, or it is deemed necessary for any reason by Wings, the pilot agrees to a checkout flight with an instructor pilot prior to any flight.
Pilots who anticipate IFR flight, are required to complete an IFR checkout flight with a Wings instructor. This may include the use of the Wings instrument PCATD simulator as well as a check out in the aircraft. Instrument flight into any meteorological conditions contrary to the certification of the aircraft are expressly prohibited. This includes any icing conditions. Prior to any flight in instrument meteorological conditions by an instrument rated pilot, the pilot must show written evidence of instrument flight rules (IFR) currency. All IFR flights into meteorological conditions below VFR will be made during daylight hours only. The IFR route must be approved by a Wings instructor prior to flight.
Night flight will only be approved for pilots appropriately certified and current for night flight. This will be in VFR conditions only. At the discretion of Wings, a pilot may be required to participate in a night flight checkout with a Wings instructor, prior to any night flight.
Geographical Limitations
The pilot agrees that the aircraft will not be flown beyond the territorial limits of the contiguous United States without the express knowledge and written permission of Wings. The pilot will disclose the destination and route of flight to Wings when scheduling the aircraft and prior to departure will leave a detailed flight plan. Upon arrival at the destination, a phone call to the office and/or Chief Pilot will be made for all cross-country flights. Telephone numbers will be provided for any planned flight outside the local area. A phone call before departure on the return leg is also expected. If the aircraft is returned to the flight school after hours, a telephone call to the Chief Pilot 541-390-3980 or Asst. Chief Instructor is expected.
Weather Limitations
Unless the pilot is fully IFR rated and current, the pilot will only operate the aircraft in areas where the present and/or forecasted weather conditions have a minimum three thousand (3,000) foot ceiling and at least seven (7) miles visibility. The VFR pilot will not operate under a special VFR clearance. Night VFR flights require a minimum ceiling of five thousand (5,000) feet and a minimum visibility of ten (10) miles. Specific local area flights in weather conditions less than the above may be individually approved by The Chief Pilot of Wings.
Liability
In the event of damage to the aircraft, other property or any personal injury, caused as a result of negligence, misconduct, pilot deficiency or pilot technique, the pilot’s responsibility may extend to damages for the personal injury and to any other property as well as to the full value of the aircraft and include loss of use, depreciation, and other losses. Information on renter pilot insurance to cover these risks, is available from Wings. Wings' liability to the pilot for any loss, shall be limited to the amount of the aircraft rental cost and shall not extend to consequential or incidental damages.
Laws and Regulations
The pilot agrees to comply with all state, federal, and local laws, regulations, and ordinances, including all Federal Aviation Regulations, while operating the aircraft. Where this agreement requires additional or stricter standards, the pilot will, to the extent not contrary to law, follow the standards set forth in this agreement.
Student Flights
Student pilots must have an instructor’s approval prior to each flight. If a student has not flown within the preceding two (2) weeks, that student must fly with a Wings instructor (dual) prior to any solo flight. All students must fly with a Wings instructor (dual) at least every thirty (30) days, regardless of any other flight time.
General Practices
No smoking is allowed in any aircraft. No animals are allowed in any aircraft. If the pilot has not arrived to pick up the aircraft thirty (30) minutes after the reserved time, the aircraft may be assigned to someone else.
Operating Practices
Wings requires that a flight plan be filed with the FAA/FSS for all flights. “Flight following” is required when available for all night and cross-country flights.
Preflight
The pilot will personally conduct a complete preflight inspection of the aircraft as prescribed by the aircraft manufacturer. This preflight inspection must include, but not be limited to, sampling of all fuel sumps, determination that the fuel and oil on board the aircraft is sufficient for the planned flight plus a minimum of 20 gallons total reserve. The pilot shall not load and unload passengers with the engine running. The pilot shall follow all checklists in the approved pilot operating handbook for the aircraft. The pilot will not hand prop or allow hand propping of the aircraft. Frost, snow, and or ice must be removed completely from the aircraft surfaces before any flight. The engine oil temperature must be in the green arc before departure.
Airports
Takeoffs and landings will only be made at public, non-residence airports, on paved runways that are at least two thousand, eight hundred (2,800) feet in length with airport field elevations at and below 1,000’ MSL. Airports with field elevations between 1,000’ MSL and 2,500’ MSL will require a runway length of three thousand feet (3,000) feet. Airports with field elevations above 2,500' MSL will require a runway length of five thousand feet (5,000) feet. Performance charts and density altitude must be considered before takeoff and landing at any airport.
The pilot will always properly secure the aircraft with appropriate gust locks and tie-downs or return it to the hangar if appropriate after each flight. When landing at a destination other than the home airport, the aircraft should be placed in a hangar in threatening weather situations.
Forced Landings and Practice Forced Landings
Simulated forced landings shall not be practiced without a Wings instructor onboard. In the event of an actual forced landing, the pilot shall not attempt a subsequent takeoff.
Mechanical Problems
In the event that mechanical or electrical repairs become necessary for continued flight and return to Wings, no repairs or expenses shall be done to the aircraft without verbal authorization by telephone from Wings.
Exceptions
Any exceptions to the provisions of this agreement, must be made in
writing by Wings. As pilot, I have read, understand and fully agree
to abide with all provisions of the above agreement. All my questions
about this agreement have been answered to my satisfaction. I have been
given my personal copy of this agreement.
